We strive to uphold a safe, fun, family-oriented environment. As such, we expect proper, respectful conduct on the premises at all times. We do not permit disrespectful conduct toward our members, guests, employees (“Team Members”), vendors or property, including but not limited to vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, fraudulent, or other inappropriate conduct or communications Or any conduct that is bothersome to members or Mei Fitness employees.
Member hereby authorizes Mei Fitness to either: 1) initiate automatic monthly debit entries to my (our) bank account beginning on the stated due date and in the amount stated, or 2) charge my credit card on a monthly basis beginning on the stated due date and in the amount stated. Member has given Mei Fitness a voided check or credit card authorization form with the required bank information and account numbers. The specific authorization is attached to this contract and incorporated by reference as if it were fully set forth. This authority is to remain in full force and effect until Mei Fitness has received a written notice of cancellation from Member. Supplementary $2.50 Service fee will be collected from membership accounts electing to use debit/credit cards as a form of monthly payment, Instead of using the recommended electronic check option by providing checking account number and routing number. If unable to successfully draft payments from your EFT Account when due, Mei Fitness will continue to attempt collection thereafter, typically each Friday of the subsequent week(s).
Obligation to Pay:
Member will not be relieved of his/her obligations to make payments agreed to by Member’s failure to use Mei Fitness facilities. Member dues are for the time period designated and do not relate to actual usage of Mei Fitness.
Delinquent / Returned Check:
If any check, draft, credit card or EFT transfer payable to Mei Fitness is not honored, Mei Fitness will assess a $15.00 collection fee for each such item and collect the current and past due amounts. If for any reason Mei Fitness is not able to collect your monthly payment on the scheduled date of every month, Mei Fitness has the right to collect any and all payments including late fees and other fees that may incur during payment processing at any time. So many days after nonpayment, your account will be sent to a collection agency and you will be responsible for all and any fees charged by the collection agency. Member understands that Mei Fitness may use services made available by card issuers which automatically update credit/debit card information and prevent disruptions due to account changes, such as an expired card or reissued card.
ORAL CANCELLATION WILL NOT BE VALID. Member may cancel this agreement by giving a written 30-day notice. Monthly Memberships will continue until receipt of a written 30-day notice requesting to terminate agreement. Cancellation notice will not be accepted until all money owed to Mei Fitness has been collected. Member will receive NO refunds for services unused or for lack of attendance by member. Member agrees to pay the remaining balance of this contract if Mei FITNESS is unable to charge account during any month. If any banking information changes, member will update account to avoid additional fees. Past monthly dues, late fees and all outstanding balances will be due immediately before this contract is terminated. Written Notice of Cancellation FORMS are available at any Mei Fitness’s place of business. Notice of cancellation is considered given, if by mail when postmarked, or if by hand delivery when delivered to Mei Fitness’s place of business. Member is responsible for verifying that the cancellation was received. Mei FITNESS will not allow any member to enter into another contract until all unpaid balances have been collected. Member indemnifies and holds Mei FITNESS harmless, against any liability pursuant to this authorization and if this account is ever past due and subsequently turned over to a collection service, member agrees to pay all collection fees in addition to obligations to Mei FITNESS. Member understands that signature on this Membership Agreement will serve as authorization for these charges. Member agrees to the terms and conditions as outlined in this statement and that all sales are final with no refunds or exchanges.
Unauthorized Personal Training:
You may not solicit or conduct on Mei Fitness premises any unauthorized personal training, with or without compensation. Mei Fitness retains sole discretion to determine whether a member or guest is engaged in personal training. If it is determined that unauthorized personal training has been conducted on the premises, the trainer and trainee will each lose their membership.
Unless expressly authorized by Mei Fitness, you may not solicit-whether in person or in writing-any members, guests or Team Members on the premises or during off-premises events, including but not limited to solicitations for political, media interviews, business opportunities, or competitive products or services.
A membership key tag will be issued to each member. A membership key tag may not be used by any other person than the member to whom it was issued. Use of your key tag by anyone else will cause it to be confiscated, and a fee will be charged to redeem it. Membership key tags must be presented at the Front Desk in order to enter the facility. If a key tag is lost, a replacement will be issued for a fee of $10.00.
You must check in at the front desk and present your membership key tag or scan your key tag. You are required to have your picture taken for your membership to identify you at check-in and for safety reasons.
Mei Fitness requires you to wear appropriate clothing and footwear while in the facilities such as gym shorts, T-shirts, jogging, aerobic and sweat outfits. No see-through clothing is allowed, clothing should not be too revealing. No open toed or open heeled shoes are allowed. You must wear proper attire at all times.
You may not modify any Mei Fitness equipment from its intended use. You may not bring in personal equipment, mechanical or otherwise, unless approved by Mei Fitness, any such approval may be revoked at any time.
Right to Revoke Membership:
Mei Fitness reserves the right to suspend or revoke membership, without refund of membership fees, for a breach of rules or regulations, violations of contract terms, or undesirable behavior as determined by Mei Fitness’s sole discretion.
Member represents that Member is in good health and has no disability, impairment, medical condition or illness preventing Member from engaging in exercise, use of Mei Fitness facilities or that poses a health risk to other users of the gym. Member assumes full responsibility for Members medical condition as it relates to his/her ability to engage in exercise. Member agrees that Member will not use any of Mei Fitness’s or its affiliated companies’ facilities with open cuts, abrasions, sores, infections, contagious conditions or maladies which may impose a health risk to others in accord with state and local health requirements. Mei Fitness management reserves the right to prohibit or limit the use of its facilities to Members with such conditions in accord with state and local health requirements.
Assumption of Risk/Personal Injury – Waiver & Release:
Member understands that the use of a fitness facility entails certain risks and dangers, including but not limited to, loss of or damage to personal property and serious personal injury, or even death. Member hereby expressly assumes all risks and responsibility for any personal injury sustained by Member (and child/charge) as a result of his/her physical exercise, use of facilities and equipment, use of tanning services, baby-sitting services and all other activity at Mei Fitness’s or its affiliated companies’ gyms(s). Member specifically releases, discharges, and agrees not to sue Mei Fitness and its affiliated companies, together with their officers, employees, independent contractors, and agents from any and all liability, loss, or expense (including legal costs) incurred by Member as a result of such personal injury and use of facilities and services.
Mei Fitness reserves the right to remove, dispose of and/or remove all articles left overnight. Mei Fitness provides lockers for your use on a daily basis only. Do not leave valuable property in a locker at any time. Mei Fitness is not responsible for any theft of, or damage to your property. If you leave a lock on the locker overnight, Mei Fitness has the right to cut it off. Mei Fitness will consider your property abandoned if left overnight. If you leave your property overnight, Mei Fitness shall have the right to donate your property to charity.
Personal Property Waiver:
Mei Fitness urges Members not to bring valuable personal property into the gym. Mei Fitness, its affiliated companies, its officers, employees, independent contractors and agents shall not be liable for the loss, theft of or damage to the Members personal property located anywhere in Mei Fitness, including all lockers. Member further agrees to waive such claims against Mei Fitness, its officers, employees, independent contractors and agents.
A guest must check in at the front desk, be at least 18, minors are acceptable if the parent or legal guardian also signs release forms), sign a medical and injury release form and pay a guest fee before using the facilities. Mei Fitness may restrict the number of guests and times you may bring guests.
Minors and Kids Room:
Please check with the front desk for specific rules, regulations, and fees covering the Kids’ Room (baby-sitting) and minors. You and your minor children must follow any such rules and regulations and pay any applicable fees. Minors Under 10: May not use the facilities at any time and are not allowed on the gym floor at any time. Mei Fitness does not permit children over six years old of the opposite sex in the locker rooms. Minors 10 – 17 May use the facilities without being accompanied by a parent or guardian if the minor is a member.
Prohibited Items and Activity:
No Alcohol, Drugs, or Smoking: You cannot use the facilities or engage in any activity at Mei Fitness while under the influence of drugs, alcohol, or medication. Also, Mei Fitness does not permit smoking, alcohol, illegal drugs, including steroids in its facilities. No Weapons: No weapons of any kind are permitted in Mei Fitness facilities. No Photographic or Video Equipment: No photography, videotaping, filming or audio recording is permitted on these premises without written permission from the management of Mei Fitness. Food & Beverages: Mei Fitness reserves the right to limit the consumption of food or beverages in workout areas.
Protective eyewear is required by LAW. Avoid overexposure; as with natural sunlight, exposure can cause eye and skin injury and allergic reactions. Repeated exposure may cause skin cancer or chronic sun damage characterized by wrinkling, drying, fragility and bruising of the skin. Ultraviolet radiation from sunlamps will aggravate the effects of the sun. Therefore, do not sunbathe before or after exposure to ultraviolet radiation. Medication or cosmetics may increase sensitivity to ultraviolet radiation. Consult a physician before using a sunlamp if you are using medication, have history of skin problems, or believe you are especially sensitive to sunlight. Individuals on birth control medication or are pregnant who use ultraviolet radiation may develop discolored skin. Failure to use protective eyewear may result in severe burns or long-term injury to the eyes.
